Terms and Conditions

ARTICLE 1: VALIDITY

1.1 Treemore B.V. is the user of these terms and conditions and has its registered office at Betula 11 in De Kwakel, registered with the Chamber of Commerce under Chamber of Commerce number 24377142 and VAT identification number NL814294327B01.

 

1.2 These general terms and conditions apply to all agreements between the customer and Treemore B.V. that are created through the website. When you purchase through www.treemore.eu, only these Terms and Conditions apply. Any other terms and conditions provided by you do not apply.

 

ARTICLE 2: PURCHASE AGREEMENT

2.1 The purchase agreement you agree to is concluded by clicking on confirm order/pay now in step 3 of the ordering process (Check your details and place your order).

 

2.2 The purchase agreement will be archived. You can inspect the agreement by contacting Treemore B.V.

 

2.3 When concluding the purchase agreement, you will receive a confirmation of the purchase agreement by e-mail. We recommend that you print this confirmation or save it permanently.

 

ARTICLE 3: PAYMENT AND DELIVERY

3.1 The price for your purchase must be paid in full before your order is sent to the person identified by you by Treemore B.V. You can pay in the ways indicated on the website.

 

3.2 The price for your order corresponds to the price stated on the treemore.eu purchase page.

 

3.3 As soon as the payment has been received by Treemore B.V., your order will be packed and shipped immediately. Your product will then be packaged shortly before the relevant shipment. Delivery of your order will be made by [COMPANY] to the address specified by you. Delivery of your order will usually take place on time. Treemore B.V. however, does not accept any liability for any later delivery.

 

3.4 If the products you have chosen are no longer available, Treemore B.V. no longer show the relevant species. If an ordered tree or plant is not available after the agreement has been concluded (because it concerns a good product), Treemore B.V. will send a replacement variety.

 

ARTICLE 4: PRODUCT RANGE / MAIN CHARACTERISTICS PLANTS AND TREES

4.1. The product range offered on the website is subject to change.

 

4.2. Treemore B.V. is not bound by its offer if there are printing, typesetting, or programming errors in its catalogues, mailings or on the website.

 

4.3 The plants or trees to be purchased by you, when packed for shipment, will not be older than plants or trees in a regular plant shop.

 

3.4 You accept that although the plants and trees will be delivered in good/reasonable condition to the address identified by you, the quality will never be fully equal to plants purchased from a brick-and-mortar store and immediately planted in a larger pot/open ground and watered.

 

 

4.5 Treemore B.V. accepts no liability regarding the plants and trees other than the obligations arising from these General Terms and Conditions. Any liability will never be higher than the price of the plants and trees paid by you.

 

3.6 All images, drawings, data, etc. of the products offered on the website are only approximate and cannot give rise to compensation and/or dissolution. Trees and plants are living products and do not look the same year-round in the climate in the BeNeLux and surrounding countries. As a result, certain images may deviate from the delivered product.

 

ARTICLE 5: RIGHT OF WITHDRAWAL

5.1 When purchasing living products such as trees, plants and hedges, the consumer has no option to dissolve the agreement after delivery. The right of withdrawal described in Article 7:46D of the Dutch Civil Code does not apply here because the purchase agreement concerns products that are alive in nature.

 

ARTICLE 6: PRIVACY

Treemore B.V. adheres to the rules of the Personal Data Protection Act. We will only use the information provided by you for the execution of the purchase agreement. If you have also subscribed to our newsletter, we refer you in that context to our privacy statement.

 

ARTICLE 7: WAIVER OF RIGHTS

Treemore B.V. may decide not to exercise certain rights arising from these Terms and Conditions for efficiency reasons. Such a decision will always only apply as a deviation in that particular case. Treemore B.V. may decide to exercise its rights under these Terms and Conditions in another similar case.

 

ARTICLE 8: APPLICABLE LAW AND CHOICE OF FORUM

8.1 These General Terms and Conditions and the purchase agreement to be concluded are governed by Dutch law to the extent permitted by law.

 

8.2 The absolutely competent court in the district of The Hague – including its judge in preliminary relief proceedings – is exclusively competent to hear any dispute about these General Terms and Conditions and/or the purchase agreement, unless the law opposes this choice of forum.

 

ARTICLE 9: DEVIATIONS

For any deviations from these General Terms and Conditions and the prices charged, please contact Treemore B.V. These deviations only apply insofar as they have been laid down in writing and signed by Treemore B.V.
